Federal employment law poster requirements

All Illinois employers must also post these employment law posters:

  • OSHA – Job Safety & Health Protection: It’s the Law
  • Employee Rights Under the Fair Labor Standards Act
  • Family and Medical Leave Act (FLMA) – Post where employees and applicants can see it. It must be placed physically. Electronic posting doesn’t replace this requirement.

  • Employee Polygraph Protection Act – The poster, supplement, and provision must be placed where employees and candidates can see it. It should be sent to labor organizations during collective bargaining.
  • Uniformed Services Employment and Reemployment Rights Act (USERRA) – Must be provided to employees covered by USERRA and posting. Email to each covered employee is okay.

Other Federal Posters You May Be Required to Post

  • Employee Rights Under the Davis-Bacon and Related Acts – Federal contractors and subcontractors must post in plants and offices where employees who fall under the NLRA do contract-related duties.
  • Employee Rights on Government Contracts Under the Service Contract Act (SCA) – Employers performing labor under SCA must provide a notice of compensation due to each covered employee plus post the information.
  • Day and Temporary Labor Services Act – Required for All IL Day and Temporary Labor Service Agencies
  • Employee Classification Act of 2008 – Required for All Construction Contractors Utilizing Independent Contractors Illinois Job Safety and Health – Required for Construction Contractors Utilizing Independent Contractors.

These are required under Illinois law for all employers who use E-Verify during employment screening and on existing employees.
