Mandatory employment law posters for Kentucky
All Kentucky employers should post these employment law posters in their most current versions in conspicuous places where the employees are likely to see them.

Mandatory employment law posters for all United States employers
Federally, you are required to post these posters as well:
- Employee Rights Under the Fair Labor Standards Act
- Family and Medical Leave Act (FMLA) – Post where employees and applicants can see it. Those undergoing employment screening need to know this is available.
- Equal Employment Opportunity is the Law – It should be where both employees and applicants can see it and be sent to labor organizations responsible for collective bargaining (if applicable).
- Employee Polygraph Protection Act – Post where employees and applicants can see it.
- Uniformed Services Employment and Reemployment Rights Act (USERRA) – It’s okay to mail it, email it, or post it electronically instead of a physical poster.
Employment law posters you may have to post
As a Kentucky employer, you also have to think about local laws. So here are some typical employees’ rights and responsibilities posters you may have to post.
- No Smoking. Post if your local government has banned smoking in or around businesses like yours.
- This Organization Participates in E-Verify. Any Kentucky employer who uses E-verify during employment screening to determine if someone can legally work in the United States must post this.

What about OSHA?
Kentucky has a special arrangement with OSHA, in which the organization approves Kentucky’s OSHA plan as better than or equal to the protection under the federal OSHA plan.

Generally speaking, electronic versions of employment law posters do not replace the need for physical posters if a company has a physical workplace or job site. If a company is 100% Internet-remote, they may comply by sending electronic versions to employees in a customary way; employees receive electronic communications.
Additionally, the posting should be available electronically to employees at all times without having to request it. This may be through an internal or external website, shared network drive, or file system.
If an employer has a hybrid remote plus on-site, they should provide electronic communications for remote employees as described above.
Do you need an attorney to review the posters?
Employment posters are legal documents. Ideally, an attorney should verify your posters—although that attorney doesn’t have to be on your payroll.
